Wedding Contract Sample

Hello! Last summer was my first year shooting weddings witch were mainly for friends and family. Now I'm getting calls from other ppl that have seen my work around. I'd rather be safe then sorry with not having some sort of contract! I made this contract up the other day. Is there anything I should add or take out?? I'm meeting with a couple tomorrow actually so your input would be great! By the way I don't have a registered business name. (yet)

Agreement

ユ It is understood that SLE Photography is the exclusive official photographer retained to perform the photographic services requested on this contract. ユ No part of any order will be delivered until the balance is paid in full. ユ SLE Photography reserves the rights to use negatives and/or reproductions for display, publication or other purposes. Negatives and previews remain the exclusive property of this studio. You may however by the rights to your photographs if you choice. ユ In the event of a postponement or cancellation of the wedding/contract, the retainer paid is not refundable. ユ The studio takes utmost care with respect to the exposure, development, and delivery of photographs. However, in the event the studio fails to comply with the terms of this contract, due to any event of act outside the control of the studio, the studioメs liability is limited to refund of the retainer. ユ NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce these photographs elsewhere without buying the rights to your photographs on CD or without photographerメs permission, and violators of this Federal Law will be subjected to its civil and criminal penalties.

I'd do a search of the board -- asked and answered many times. There are some great premade contracts, or do what I did and have a lawyer create one for you. $500 spent now could save you thousands in legal fees down the road.

Regarding content I am not sure so can not say...regarding proofing for incorrect spellings..."by the rights" should be, buy.

I agree with either using a premade one, having a lawyer whip one up for you, or at the very least, definitely proof your copy before you present it to the couple. Spelling and punctuation errors don't create as professional an impression (a-la-cart is a la carte, not every word ending in an "s" requires an apostrophe, etc.) :)

Do you have a 'terms and conditions' section? What you have posted is all necessary information, but it isn't really a contract. It's more of a summary for your own use.

Little of that is relevant to a wedding contract. It is good to have, and it is very good to have in your own notes, but there is no need to reiterate that to the client.

There are many books regarding the issue of contracts and I would recommend buying one of them. I bought 'contracts for wedding and portrait photogrpahers' and 'licensing photography.' I found them both a very good and informative read.

Heads-Up. There is a Great Book by Tad Crawford entitled "Business and Legal Forms for Photoraphers". I purchased this book at half.com for $21.00 usd (it is $30.00 at the book store) and it comes with a great CD as well. This book is essential for every photographer as we can be sued for just about anything here in the States. I just started my company Back 2 Life Creations a few weeks ago and this book saved me literally hundreds of thousands of dollars. I have no start up except for my current job as a collections agent but Its enough to do what I do. The contracts and legal jargon that I have to deal with in this business is ridiculous but its better to be safe than sorry. Well I hope this was helpful and I wish everyone the best.
